SUSPENSION AND REMOVAL OF SUPERINTENDENT
Date: JANUARY 4, 1999
The County Board of Education may suspend the County School Superintendent for incompetency, willful neglect of duty, misconduct, immorality, or the commission of crime involving moral turpitude and for other good and sufficient cause.
The County School Superintendent may be removed from office before the expiration of his/her contract by a majority vote of the County Board of Education for inefficiency; incapacity; neglect of duty, or malfeasance or corruption in office, pursuant to the Fair Dismissal Law.
The Superintendent shall be given:
1. A hearing on the charge or charges;
2. Ten days written notice of the time and place of the hearing containing a brief general statement and enumeration of the charge or charges;
3. An opportunity to present a defense following due process procedures including legal counsel; compulsory attendance of witnesses and production of documents; and cross-examination of witnesses.
